3. Quotes and Pricing
The following terms apply to all quotes provided by Fort Knox Security:
- Validity: All written quotes are valid for thirty (30) days from the date of issue, unless otherwise stated on the quote. After this period, we reserve the right to revise the quoted price.
- Site assessment: All quotes are subject to a site assessment. The final scope of work and pricing may be adjusted following a physical inspection of the property to account for factors not apparent at the time of the initial enquiry, including but not limited to property construction, cable run distances, access difficulties, and existing infrastructure.
- Price changes: Quoted prices are based on the cost of equipment and labour at the time of quoting. We reserve the right to adjust pricing where there are significant changes in supplier costs or where the scope of work changes at the customer's request.
- GST: Unless otherwise stated, all prices quoted by Fort Knox Security are inclusive of GST.
- Payment terms: Payment terms will be specified on the quote or invoice. We may require a deposit before commencing work. Full payment is due upon completion of the installation unless alternative arrangements have been agreed in writing.
- Acceptance: A quote becomes a binding agreement when you accept it in writing (including via email) or verbally instruct us to proceed with the work.
4. Installation Services
When you engage Fort Knox Security to install a security system, the following terms apply:
- Access: You agree to provide our technicians with safe and reasonable access to your property at the agreed time. If access is not available and the appointment must be rescheduled, we may charge a call-out fee at our discretion.
- Property modifications: Security installations typically require drilling holes, running cables, and mounting equipment to walls, ceilings, and other surfaces. By accepting a quote, you consent to these necessary modifications to your property.
- Existing infrastructure: We will take reasonable care when working with existing wiring, structures, and fittings. However, we are not liable for damage to concealed pipes, wires, or other infrastructure that is not visible or disclosed to us prior to installation.
- Completion: We will make reasonable efforts to complete installations within the estimated timeframe. However, completion times are estimates only and may be affected by factors outside our control, including weather, supply delays, and site conditions.
5. Warranties
Fort Knox Security provides the following warranties on our installations and equipment:
- Workmanship warranty: All installation work performed by Fort Knox Security is warranted against defects in workmanship for a period of twenty-four (24) months from the date of installation. If a fault occurs due to our workmanship during this period, we will rectify it at no charge.
- Equipment warranty: All equipment supplied by Fort Knox Security carries the manufacturer's warranty. Warranty periods vary by product and manufacturer. Details of the applicable warranty period will be provided at the time of purchase. We will assist you in making warranty claims with the manufacturer where applicable.
- Exclusions: Warranties do not cover damage caused by misuse, tampering, unauthorised modification, power surges, lightning strikes, water damage (unless the equipment is rated for outdoor use and installed correctly), pest damage, or general wear and tear.
These warranties are in addition to, and do not limit, your rights under the Australian Consumer Law (see Section 9 below).
6. Monitoring Services
If you subscribe to our security monitoring service, the following additional terms apply:
- Monitoring agreement: Monitoring services are provided under a separate monitoring agreement. The terms of that agreement, including the monitoring period, fees, and cancellation provisions, will be provided to you before you commence the service.
- Response: Upon receiving an alarm signal, our monitoring centre will follow the agreed response protocol, which may include contacting you, your nominated keyholders, and/or the relevant emergency services. We cannot guarantee response times from third parties, including police, fire, or ambulance services.
- System maintenance: It is your responsibility to ensure that your security system remains in proper working order. This includes replacing batteries, maintaining a functioning internet or phone connection (as applicable), and promptly reporting any faults to us.
- False alarms: You are responsible for ensuring that your system is operated correctly to minimise false alarms. You may be liable for any fees or fines imposed by South Australia Police or other authorities in relation to repeated false alarm activations.
- Communication lines: Monitoring relies on communication between your security system and our monitoring centre via telephone, internet, or mobile (4G) networks. We are not responsible for interruptions to monitoring caused by failures in these communication networks that are outside our control.
- Cancellation: Monitoring services may be cancelled in accordance with the terms of your monitoring agreement. A minimum notice period may apply.
7. Limitation of Liability
To the maximum extent permitted by law:
- Fort Knox Security, its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, property, or business opportunity, arising from or in connection with the use of our website, the installation of security equipment, or the provision of monitoring services.
- Our total liability to you for any claim arising under or in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount you have paid to Fort Knox Security for the specific services giving rise to the claim.
- Security systems are designed to reduce the risk of security incidents but cannot eliminate that risk entirely. We do not guarantee that our systems or services will prevent break-ins, theft, damage, personal injury, or any other security event. No security system is infallible.
- We are not liable for any loss or damage resulting from failure of the security system due to power outages, communication network failures, or any other circumstances beyond our reasonable control.
8. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Fort Knox Security or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.
9. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable consumer protection legislation that cannot be excluded by agreement.
Under the Australian Consumer Law, our services come with guarantees that cannot be excluded, including guarantees that services will be:
- Provided with due care and skill
- Fit for the purpose for which they are commonly supplied
- Provided within a reasonable time (when no time is specified)
If we fail to comply with a consumer guarantee, you may be entitled to a remedy, including a refund, repair, or compensation for any resulting loss or damage, depending on the nature and severity of the failure.
10. Indemnification
You agree to indemnify and hold harmless Fort Knox Security, its directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or in connection with:
- Your breach of these Terms
- Your misuse of our website or services
- Any third-party claim relating to actions you have taken using our services or equipment
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of South Australia and the Commonwealth of Australia. You irrevocably submit to the exclusive jurisdiction of the courts of South Australia and any courts competent to hear appeals from those courts in respect of any proceedings arising out of or in connection with these Terms.
12. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.
